Terms and Conditions (AGB) of Choisy AG  

Valid from March 31, 2023.

1. GENERAL

 

1.1 These General Terms and Conditions (GTC) govern the business relationships between Choisy AG (we, us) and its customers (natural or legal persons). They form an integral part of every contract concluded between Choisy AG and a customer. These conditions apply to all offers, sales, and deliveries made by Choisy AG.

 

1.2 These GTC conclusively regulate all types of contract violations and their legal consequences, as well as all claims from customers. Unless otherwise required by law, all further claims from the customer as a buyer are excluded.

 

1.3 Choisy AG reserves the right to change these General Terms and Conditions at any time and without prior notice. The applicable GTC are those published on the Choisy AG website.

2. ORDERS

 

2.1 Orders can be placed as follows:

 

For next-day delivery (only on weekdays), the order must be placed by 10:00 a.m. the day before, provided the ordered product is in stock. If the product is unavailable, we will contact the customer to arrange an alternative delivery option.

 

2.2 The following delivery conditions apply:  

  • Orders under CHF 180.-, delivery surcharge CHF 38.-

  • Orders from CHF 180 to CHF 350.-, delivery surcharge CHF 19.-  

  • Orders from CHF 350.-, free delivery.

3. CONCLUSION OF CONTRACT

 

The purchase contract between the customer and Choisy AG is concluded as soon as the customer places an order by email, phone, or via the contact form on the Choisy AG website, and this order is confirmed by Choisy AG via email.

4. TRANSPORT, QUALITY ASSURANCE, AND RETURNS

 

4.1 Choisy AG places great importance on excellent customer service to guarantee the best possible quality of our frozen foods. Since these products are perishable goods, returns or exchanges of already delivered products are excluded.

 

4.2 Our contracted logistics provider is required to maintain the cold chain between our cold storage and the recipient (our customer) without interruption. If the customer notices visible damage to the packaging or contents upon receiving the goods that can be attributed to transport, they must immediately report these defects to the driver, photograph them, and refuse to accept the goods. In this case, the transport damage will be considered a defect. The customer must also document the damage with photos and report it immediately to our customer service by email at info@choisy.ch or by phone at 077 445 41 63 during business hours from Monday to Friday, 08:00 to 12:00 and 13:30 to 16:00.

 

4.3 If the customer notices quality defects such as manufacturing errors, expired expiration dates, or labeling errors after receiving the goods, they must inform us in writing immediately about these defects. Products are deemed approved if not immediately objected to upon receipt. Choisy AG reserves the right to request proof of the defect. Please note that the intrinsic quality of the products that does not meet the customer’s taste preferences does not constitute a defect. Also, the representation of products on the website or in the catalog is only a visual representation and does not make binding statements about the condition of the products.

 

4.4 To ensure that our high-quality products retain their quality, we recommend storing them immediately upon receipt at -18°C. Please observe the expiration date indicated on the product packaging.

 

4.5 We reserve the right to change our offers at any time without prior notice. Invoicing will be based on the actual quantities delivered. Returned goods must be sent back in the same condition as when purchased. Our general sales conditions are binding and cannot be replaced by conditions from our customers. All delivery orders are subject to Swiss law.

5. PRICE

 

The current prices are those listed in the price list sent to the customer. Choisy AG reserves the right to change the prices. In such cases, we will inform our customers in a timely manner.

6. PAYMENTS

 

6.1 The invoice will be issued after the goods are delivered to the customer and is due for payment within 30 days from the invoice date. Please note that the delivered goods remain the property of Choisy AG until full payment is received.

 

6.2 For new customers whose order exceeds CHF 200, payment must be made before the goods are shipped. In this case, delivery will only take place once the full amount has been received. In some other cases, prepayment may also be required.

7. DATA PROTECTION

 

7.1 Choisy AG stores the data necessary for processing business transactions and does not share it with third parties, except for logistics companies commissioned with the delivery. The data is used solely for customer relationship management within Choisy AG.

 

7.2 Choisy AG may conduct written communication regarding orders or other matters electronically. The customer is expressly informed that there are security risks when transmitting data via email, such as virus transmission, data corruption, data loss, or access by third parties, which cannot be controlled by Choisy AG. By placing an order, the customer agrees that Choisy AG may receive and send documents and other data electronically, including unencrypted emails.

8. JURISDICTION

 

We strive to find out-of-court solutions in case of disputes. However, if this is not possible, legal disputes will be settled before the regular Swiss courts. The exclusive jurisdiction for all legal disputes is Zurich.
